My husband and I bought a car and our loan was sold to Santander, I had back surgery and was out of work and we had fallen behind on our payment. One day I had a guy show up at my door to repo my car and I called them to pay my bill to catch it up and they refused to take my debit card. They took my car and we had to send them the money western union when we went to pick our car up the guy that repo'd our car took our license plates so we both lost a day of work waiting for one of my co workers to bring our plates to where we lived because he lived in a different city. We ended up filing bankruptcy and did not include our loan we continued to pay our loan. However, Santander did not reinstate our loan so it didn't show that we were paying it on our credit. I called to make my final payment and they didn't have us in their system. They sent us a check and I called to find out why and they said our loan was paid in full and was over paid....they then told us that it was money posted to our account in error that we still owed but no one can tell us how much. NOW when we call they don't have us in their system yet they are still a Lien holder on our title so we can't sell the car or even junk it because no mechanic can figure out what is wrong with it and it doesn't run. They charged us so many fee's its unbelievable.....can we join the suit or is there anything you can do to help us get a release on our title??????????? 12a76ff

Funny... its so common. Everyone has a sad story on why they cant make their payments. But when they get repossessed, LOW AND BEHOLD! THEY HAVE 1000+ DOLLARS TO SEND IN TO GET THE VEHICLE BACK! good job! you wasted all that money in repo and transportation charges when you could have paid half of that on your payment and not have the headache. Learn to budget. If you arnt getting your title, and want to complain about it, then at least say who originally had the loan before santander bought them out. (they probably have the title) and santander already released the lien to them. That means, you guessed it, some other banks fault.

I just read your post, a have been going throught the same thing with them as well. My orginal loan with Citi had matured in 1-2011. I continued to pay even after that because Santander told me I had too. When I refused to sign another contract with them,they sent a repo company to get my car. They then told me that even tho I'd still been making the contract payments, I would need to sign another contract with them to get my car back. I faxed back the paper work, they didnt tell me where my car was for 4 days. The contract with them ended on 1-2012, now they are saying OI owe another $1200. Is this legal and do we the consumer have anytype of protection??

I refinanced my car with my own bank. My bank sought the lein release and surprisingly Santander not show up on my title the same day. This was just in the last 2 days I had refinanced.
